Welcome to WaveHub

These Terms and Conditions govern your use of the WaveHub marketplace platform. By accessing or using WaveHub, you agree to be bound by these terms. WaveHub is a peer-to-peer marketplace connecting buyers and sellers of ocean sports equipment including kitesurfing, surfing, windsurfing, foiling, SUP, and paragliding gear.

1. Acceptance of Terms

By creating an account, accessing, or using WaveHub services, you agree to:

  • Be at least 18 years of age or have parental/guardian consent
  • Provide accurate, current, and complete information
  • Comply with all applicable laws and regulations
  • Accept sole responsibility for your account activity

2. Platform Purpose and Nature

WaveHub operates as a peer-to-peer marketplace platform. We facilitate connections between private buyers and sellers but are not a party to any transactions. Important distinctions:

What WaveHub Provides:

  • • Platform infrastructure for listing and browsing items
  • • Communication tools between buyers and sellers
  • • User verification and safety features
  • • Dispute mediation services (not arbitration)
  • • Community guidelines and moderation

What WaveHub Does NOT Provide:

  • • Ownership or possession of listed items
  • • Warranties or guarantees on items
  • • Payment processing or escrow services
  • • Shipping or delivery services
  • • Verification of item authenticity or condition
  • • Legal representation in disputes

3. User Accounts and Registration

Account Creation

To use WaveHub's marketplace features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Keeping your contact information current and accurate

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to the community. You may close your account at any time through your account settings.

4. Seller Obligations and Responsibilities

Listing Requirements

As a seller, you must:

Accurate Descriptions: Provide truthful, complete descriptions of items including condition, defects, modifications, and specifications
Authentic Photos: Use your own photos that accurately represent the actual item for sale
Proper Categorization: List items in the correct category with appropriate tags
Legal Ownership: Only sell items you legally own and have the right to sell
Fair Pricing: Set prices that reflect the item's condition and market value

Communication and Delivery

  • Respond to buyer inquiries within 48 hours
  • Honor agreed-upon meeting times and locations
  • Provide tracking information if shipping
  • Complete transactions as agreed or notify buyers of any changes promptly

5. Buyer Obligations and Responsibilities

As a buyer, you must:

  • Inspect Before Purchase: Thoroughly inspect items before completing the transaction when possible
  • Ask Questions: Seek clarification on any uncertainties before committing to purchase
  • Honor Commitments: Follow through on agreed purchases or notify sellers promptly if circumstances change
  • Safe Transactions: Meet in public places and use secure payment methods
  • Report Issues: Notify WaveHub of any fraudulent listings or seller misconduct

6. Prohibited Activities

The following activities are strictly prohibited and may result in immediate account termination:

Fraud & Deception:

  • • Listing items you don't possess
  • • Using stolen or stock photos
  • • Misrepresenting item condition
  • • Price manipulation or bid rigging
  • • Identity fraud or impersonation

Illegal Activities:

  • • Selling stolen property
  • • Selling counterfeit items
  • • Money laundering
  • • Tax evasion schemes
  • • Violation of import/export laws

Platform Abuse:

  • • Creating multiple accounts to evade bans
  • • Manipulating ratings or reviews
  • • Spamming or unsolicited marketing
  • • Scraping or data harvesting
  • • Interfering with platform operations

Harmful Behavior:

  • • Harassment or threats
  • • Hate speech or discrimination
  • • Doxxing or privacy violations
  • • Malware or phishing attempts
  • • Exploiting platform vulnerabilities

7. Payments and Fees

Platform Fees

WaveHub is currently free to use for basic listings. We reserve the right to introduce:

  • Premium listing features (featured placements, promotional boosts)
  • Business account subscriptions
  • Transaction fees for certain payment methods

Users will be notified at least 30 days before any new fees are implemented.

Payment Between Users

WaveHub does not process payments between buyers and sellers. Users arrange payment methods privately. We recommend using secure, trackable payment methods and never sending cash through mail.

8. Liability and Disclaimers

Important Disclaimer

WaveHub is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We explicitly disclaim all warranties, express or implied, including:

  • Accuracy, reliability, or quality of listings or user-generated content
  • Authenticity, safety, or legality of items listed
  • Successful completion of transactions
  • Uninterrupted or error-free platform operation

Limitation of Liability

To the maximum extent permitted by law, WaveHub and its operators shall not be liable for:

  • Direct, indirect, incidental, or consequential damages arising from platform use
  • Lost profits, data, or business opportunities
  • Disputes between users
  • Actions or omissions of other users
  • Unauthorized access to your account or data

9. Dispute Resolution

Between Users

WaveHub encourages users to resolve disputes directly. If mediation is needed:

  1. Contact the other party through our messaging system
  2. Document all communications and evidence
  3. Report the issue to WaveHub if resolution isn't reached
  4. WaveHub will review and may provide non-binding recommendations

With WaveHub

For disputes with WaveHub, users in South Africa agree to first attempt resolution through good faith negotiations. If unsuccessful, disputes will be resolved through arbitration in accordance with South African law.

10. Intellectual Property Rights

Your Content

You retain ownership of content you post (photos, descriptions, reviews). By posting, you grant WaveHub a non-exclusive, worldwide, royalty-free license to:

  • Display your content on the platform
  • Use content for marketing and promotional purposes
  • Modify content for formatting or technical requirements

WaveHub's Property

All platform code, design, logos, trademarks, and functionality are owned by WaveHub and protected by copyright and trademark laws. Unauthorized use is prohibited.

11. Privacy and Data Protection

Your use of WaveHub is also governed by our Privacy Policy. Key points:

  • We collect minimal personal data necessary for platform operation
  • We do not sell your personal information to third parties
  • You can request deletion of your account and data at any time
  • We comply with applicable data protection regulations (POPIA)

12. Modifications to Terms

WaveHub reserves the right to modify these Terms at any time. Significant changes will be communicated via email and/or platform notification at least 14 days before taking effect. Continued use of the platform after changes constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of South Africa. Any legal proceedings shall be conducted in South African courts, subject to the arbitration provisions outlined in Section 9.

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect. Failure to enforce any right or provision does not constitute a waiver of such right or provision.
